Cargo Coverage & Liability Disclaimer
Road Flex Courier LLC provides courier and delivery services. Unless a higher value is declared and approved before transportation, our liability for loss or damage is limited to $100 or the documented value of the damaged or lost item, whichever is less. This limitation applies regardless of purchase price or replacement cost.
Additional Cargo Coverage
Customers may request additional cargo coverage for shipments. The additional charge is $1.75 for each $100 of declared value. The maximum declared value available through Road Flex Courier LLC is $5,000 per shipment. Coverage is limited to the lesser of the approved declared value or the actual value. Additional coverage is not automatic. Before we proceed with a shipment requiring increased protection, the customer must complete and submit our Cargo Declaration Form, identifying the shipment, contents, and declared value. Any required coverage fee must be paid and accepted.
Excluded Items
Road Flex Courier LLC does not accept responsibility for extraordinary-value items, including cash, currency, jewelry, precious metals, gemstones, securities, negotiable instruments, bullion, coins, fine art, furs, or similar valuables. Hazardous materials, prohibited goods, and improperly declared materials are also not accepted. Customers are responsible for accurately describing shipment contents and complying with transportation, aviation, postal, and governmental requirements.
Packaging and Shipment Condition
The shipper is responsible for packaging, securing, labeling, and addressing each shipment so it can withstand normal handling and transportation. Glass, fragile merchandise, electronics, and other damage-sensitive items must be packaged or crated and identified. Claims may be denied when damage results from inadequate packaging, insufficient protection, inherent defects, improper labeling, or the nature of the goods.
Limits of Liability
Road Flex Courier LLC is not responsible for loss, damage, delay, misdelivery, or non-delivery resulting from the shipper’s acts or omissions, improper instructions, inadequate packaging, inherent vice, government action, public authority, weather or other events beyond reasonable control, civil disturbances, labor disruptions, fuel shortages, transportation interruptions, or acts of God. Road Flex Courier LLC may open and inspect shipments when necessary for safety, security, or compliance. Shipments may also be weighed or reweighed, and charges may be adjusted based on weight or applicable service requirements.
Claims Process
All loss or damage claims must be submitted in writing to Road Flex Courier LLC within 24 hours after delivery or acceptance by the consignee, unless a longer period is required by applicable law. The claimant must retain packaging and damaged merchandise for inspection and provide proof of loss, including invoices, receipts, photographs, and documentation. Transportation charges must be paid in full before a claim is processed, and claim amounts may not be deducted from service charges.
Customers agree to cooperate with Road Flex Courier LLC and an insurer in investigating and recovering losses. Rights of recovery or subrogation may be transferred to Road Flex Courier LLC or its insurer.
