Disclaimer: Road Flex Courier, LLC. is responsible for providing special handling services for goods that are booked under special conditions. Road Flex Courier, LLC. will not be responsible for the cost of any item(s) that are NOT declared at the time when the order is placed. Our limit of liability is $100 per delivery, unless declared otherwise. All damage claims must be made while the driver is at the delivery location. Once a signature has been obtained and the driver has departed, Road Flex Courier, LLC. cannot be held responsible or liable for any losses or damages to the shipment.
Payment Terms: If you are an established account holder, payments must be received within seven (7) days from the presentation of the bills by Road Flex Courier, LLC. Customers or clients who are under contract with Road Flex Courier, LLC. are required to pay in a timely manner. Customers are fully responsible for all service charges that may be incurred for returned/bounced check fees collected by the bank, regardless of the amount of the check or the reason why it was returned. Payments that have not been made within 7 days from the invoice due date will be charged $5 per week until the payment is received.
Delivery Time: All same-day deliveries are subject to availability and terms. Some deliveries may be delayed or rescheduled due to factors such as excessive traffic, lack of availability, inclement weather conditions, official activities, and other unforeseen delays. Should any of these issues arise, additional time might be needed to deliver the good(s). In addition, the client will be promptly notified by the assigned driver or dispatcher.
Weight Limit: The weight limit must meet or be less than the maximum assigned value. If the maximum assigned weight limit is exceeded, an extra charge will be incurred.
Mishandling: Road Flex Courier, LLC. only provides assurance on the safe delivery of the products. Any mishandling at the customer’s site will not be termed into the liability of Road Flex Courier, LLC.
Liability of Loss or Damages: We will not be liable for any loss or damage to shipments of cash, currency, negotiable instruments, or other prohibited items that include, but are not limited to, stamps, coins, jewelry, original artwork, and any type of perishable goods. We will not accept liability for items that are not fully enclosed in a carton or proper packaging material. We do not accept hazardous goods; that is, any goods that fall within the specifications of the Dangerous Goods Act.
Cancellation: We have the option, but are not obligated, to open and inspect clients’ packages prior to or after they have been presented to us for delivery. All shipments MUST be free of oil leaks, grease, or dirt, and there must not be any sharp corners or objects protruding from the package. At the present time, the maximum size (i.e., length and girth combined) of a package that will be accepted by Road Flex Courier, LLC for delivery is 45 inches wide. Further, the maximum length of a package which will be accepted for delivery by Road Flex Courier, LLC is 65 inches long. Road Flex Courier, LLC will not accept for delivery any hazardous materials that require a vehicle placard. We reserve the right to reject a shipment at any time, when such shipment would be likely to cause damage or delay to other shipments, equipment, or personnel, or if the transportation of such shipment is prohibited by law. We do not accept any liability for the failure of Road Flex Courier, LLC to properly collect or remit funds for C.O.D. shipments, or to collect signatures for deliveries that have been performed.
Acts of Omission: In any event, Road Flex Courier, LLC will not be liable for any damages (i.e., whether direct, incidental, special, or consequential) that include, but are not limited to, a loss of income or profits, whether or not Road Flex Courier, LLC had knowledge that such damages might be incurred. Road Flex Courier, LLC will not be liable for:
1) acts or omissions including, but not limited to, an incorrect declaration of cargo; improper or insufficient packaging; any failure to secure, mark, or address the client’s shipment; or for the acts or omissions of the recipient.
2) Concealed damage in packages that were packed and sealed by the shipper.
3) Theft or pilferage in packages that were packed and sealed by the shipper.
Compliance with Laws: The user assumes all knowledge of applicable law and is responsible for compliance with any such laws. The user may not use the services that are offered by Road Flex Courier, LLC in any way that violates applicable state, federal, or international laws, regulations, or other government requirements. The user further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law or regulation.
